WIPO News: New edition of the Locarno Classification

On the 1st January 2017 a new edition of the „Locarno Classification“- international classification used for the purposes of the registration of industrial designs – has entered into force.

The new edition is available on the website of the World Intellectual Property Office and will be applied to all the international applications filed on/after the above-mentioned date. However, the classification has merely administrative purposes, thus is not binding for the contracting parties.

The European Union Intellectual Property Office – EUIPO – uses a list of products which is based on the Locarno Classification and is called „Eurolocarno“. The office advises the applicants to always use the terms from the Locarno Classification or from Eurolocarno in their design applications.

Einreichung von Schutzschriften ab 01.01.2017 ausschließlich elektronisch zum Schutzschriftenregister

Ab dem 01.01.2017 sind Rechtsanwälte verpflichtet, Schutzschriften ausschließlich elektronisch zum Schutzschriftenregister einzureichen.

Mit dem Gesetz zur Förderung des elektronischen Rechtsverkehrs mit den Gerichten vom 10.10.2013 wurde zum 01.01.2016 das zentrale, länderübergreifende elektronische Register für Schutzschriften eingeführt (https://schutzschriftenregister.hessen.de/).

Das Vereinigte Königreich wird das neue EU Patensystem ratifizieren

Die britische Ministerin für Gewerblichen Rechtsschutz, Baroness Neville-Rolfe, hat erklärt, dass das Vereinigte Königreichs, trotz des Brexit, sich dem europäischen Unified Patent Court (UPC) anschließen wird. Weiter teilte die Ministerin mit, dass Großbritannien in der nächsten Monaten die erforderlichen Schritte für die Ratifizierung durchführen und mit dem Vorbereitungskomitee die nötige Aufgaben vornehmen wird, so dass das neue Patentgericht alsbaldig seine Arbeit aufnehmen kann.

Diese Bekanntmachung war sehr überraschend, da es schien, dass England nach den Brexit aus dem EU Patent-System aussteigen wollte. Zwei Zentralabteilungen des UPC werden in München bzw. in London eingerichtet, weitere Regionalkammern werden in Mannheim, Düsseldorf, Mailand und Stockholm sein, während die Widerspruchsabteilung wird in Luxemburg abgestellt sein. Das neue Patentsystem muss dennoch Urteile von Europäischen Gerichtshof annehmen.

Weil diese Erklärung bereits Anlass zu Spekulationen gibt, erklärt Baroness Newille-Rolfe, dass diese Entscheidung nicht als Rückzeug aus Verhandlung in Bezug auf Brexit gesehen werden darf.

Wir sind nun gespannt wie die weitere Entwicklung des Vorbereitungsverfahren verlaufen und und wann das UPC sein Arbeit annehmen wird.

The UK will ratify the EU patent system

The UK Intellectual Poperty Minister, Baroness Neville-Rolfe, has announced that the UK will join the European Unified Patent Court (UPC), despite the Brexit. Moreover the IP Minister said that during the next months Great Britain will undertake the necessary steps for the ratifying process and together with the Preparatory Comittee of the UPC will carry out the necessary tasks in order for the new Patent Court to start its work as soon as possible.

The announcement was quite surprising, as after the Brexit the UK was expected to step out of the EU Patent System. Two Central Divisions of the UPC will be in Munich and London respectively, additional local divions will be situated in Mannheim, Düsseldorf, Milan and Stockholm, while the court of appeal will be in Luxembourg. The new Patent System will have to accept rulings from the European Court of Justice.

As this declaration has already given rise to many speculations regarding the Brexit approach, Baroness Newille-Rolfe has stated that it is not to be regarded as a sign of wihdrawal negotiations regarding the Brexit.

We are curious to see how the prepratory proceedings will continue and looking forward for the UPC to start its work.

WIPO NEWS: Changes to the amounts of individual fees

According to the latest Information Notices issued by WIPO there will be changes regarding the amounts of the individual fees in the countries mentioned below. The new amounts will apply for international applications, subsequent designations and applications‘ renewals.

The concerned contracting parties of the Madrid Protocol are as follows:

  • United Kingdom (as from 10.12.2016):

→ Application or subsequent designation: 227 CHF for one class of goods and services, 63 CHF for each additional class;

→ Renewal: 252 CHF for one class, 63 CHF for each additional class.

  • United States of America (starting on 14.01.2017):

→ Application and subsequent designation: 388 CHF for each class of goods and services;

→ Renewal: 291 CHF for each class of goods and services.

  • Japan (14.12.2016)

→ Application or subsequent designation: (First part) 108 CHF for one class, 82 CHF for each additional class of goods and services; (Second part) 269 CHF for each class.

→ Renewal: 371 CHF for each class of goods and services.

Change of the Individual Fee in Mexico

According to the new WIPO Information Office No. 27/2016 the new amount of the individual fees payable when Mexico is designated in an international applications are (in Swiss francs):

– 149 CHF → Applications or subsequent designations (for each class of goods and services);

– 160 CHF → Renewals (for each class of goods and services).

New Edition of the Nice Classification

As from the 1st January 2017 a new edition of the Nice Classification (International Classification of Goods and Services for the Purposes of the Registration of Marks), the 11th, will enter into force. There will be a number of changes, anyway WIPO will not reclassify, in accordance with the new edition, the list of goods and services of an international registration subject, after 31.12.2016, of a renewal, subsequent designation or any other change affecting the list.

Starting with the 24.10.2016 Philippines has joined TMClass (an online consultation tool which allows users to search trade marks registered in the EU or in the other participating offices), bringing the number of national and regional Intellectual Property Offices in the tool to 62.
